1. What is a science and technology enterprise?

Science and technology enterprise means an enterprise established and operating under Vietnamese law and performing production, business and services from science and technology results.

2. Determining What is the Scientific and Technological Outcomes?

1. Results of performing scientific and technological activities, results of performing scientific and technological tasks, and results of scientific research and technological development are hereinafter referred to as scientific and technological results. Science and technology results are the basis for consideration for granting certificates of science and technology enterprises.

2. Scientific and technological results can be expressed in one of the following forms:

a) Inventions, utility solutions, industrial designs, layout designs of semiconductor integrated circuits, plant varieties that have been granted protection titles in accordance with the provisions of the law on intellectual property or are recognized international registration under the provisions of international treaties to which Vietnam is a contracting party; computer programs that have been granted copyright registration certificates;

b) New livestock breeds, new plant varieties, new aquatic plant varieties, new forestry plant varieties, and technical advances already recognized by the Ministry of Agriculture and Rural Development;

c) The results of the performance of tasks, which have been awarded with science and technology awards, presided over by competent state agencies, coordinated with the awarding organization or agreed to the awarding organization. in accordance with the law on science and technology awards;

d) Scientific and technological results certified and recognized by competent authorities in accordance with law;

dd) The transferred technology is certified by a competent authority in accordance with law.

3. Enterprise implementation of new investment projects in the field of scientific research and technological development means the use of scientific and technological results by enterprises to implement new or replacement production and business projects. all existing technologies in production and business activities of the enterprise.

3. Value of Science and Technology Enterprise Certificate

1. The certificate of science and technology enterprise is the basis for the implementation of preferential and supportive policies for science and technology enterprises and takes effect nationwide.

2. The certificate of science and technology enterprise is concurrently a certificate of registration of scientific and technological activities.

3. The certificate of science and technology enterprise is the basis for applying investment incentives to science and technology enterprises.

Tax incentives for science and technology enterprises

1. Exemption and reduction of corporate income tax

Incomes of science and technology enterprises from production and trading activities of products formed from scientific and technological results are entitled to incentives, exemption from and reduction of corporate income tax like enterprises implementing projects. New investment in scientific research and technological development, specifically: Tax exemption for 04 years and 50% reduction of payable tax for the next 09 years.

2. Determination of income of exempted science and technology enterprises

Turnover and income from production and trading of products formed from scientific and technological results as prescribed in Clause 1, Article 2 of this Decree.

Clause 1, Article 2 of Decree 13/2019/ND-CP stipulates: Products formed from scientific and technological results (including: post-incubation technology, goods, services and other forms) ) is the result of a process of producing or providing a service based on the application, application or development of scientific and technological results.

Revenue and income generated from services with application of scientific and technological results in the field of information technology must be revenue or income from new services.

Science and technology enterprises are not entitled to corporate income tax exemption or reduction incentives for the fiscal year that fail to meet the conditions on turnover of products formed from scientific and technological results reaching the maximum rate. minimum 30% on the total revenue of the business.

3. Procedures for enterprise income tax incentives for science and technology enterprises

Conditions and procedures for enterprise income tax incentives shall comply with the provisions of the law on corporate income tax and tax administration.
