RESOLUTION

AMENDING AND SUPPLEMENTING THE GOVERNMENT's Resolution No. 42/NQ-CP DATE April 09, 4 OF THE GOVERNMENT ON MEASURES TO SUPPORT PEOPLE IN DIFFICULTY BECAUSE OF THE COVID-2020 PLAN

GOVERMENT

Pursuant to the Law on Government Organization dated June 19, 6;

Pursuant to the Government's Decree No. 138/2016/ND-CP dated October 01, 10 promulgating the Government's working regulations;

On the basis of the proposal of the Minister of Labor, War Invalids and Social Affairs in Report No. 104/TTr-LDTBXH dated October 14, 10.

DECIDES:

1. Amending and supplementing Resolution No. 42/NQ-CP dated April 09, 4 of the Government on measures to support people facing difficulties due to the Covid-2020 pandemic as follows:

a) At Point 1, Section II, amend and supplement as follows:

“Employees working under the labor contract regime must agree to suspend the performance of the labor contract, take unpaid leave from work for 01 month or more established by enterprises, private or private educational institutions or institutions. Public education institutions self-finance recurrent expenditures at preschool, kindergarten, elementary, middle and high school levels facing difficulties due to the Covid-19 pandemic, having no revenue or no resources. financial support to pay salary is supported at the rate of 1.800.000 VND/person/month. The support period according to the actual time of suspending the performance of labor contracts, taking unpaid leave, monthly depending on the actual situation of the epidemic, from April 01, 4 and not more than 2020 months .”

b) At Point 2, Section II, amend and supplement as follows:

Employers whose revenue in the first quarter of 2020 decreased by 20% or more compared to the fourth quarter of 2019 or the revenue of the preceding quarter before the time of requesting for consideration for entitlement to decrease by 20% or more compared to the same period in 2019 shall be entitled to: Borrowing without collateral up to 50% of the regional minimum salary to pay stoppage wages for employees as prescribed in Clause 3, Article 98 of the Labor Code in the period from April to December 4 according to the provisions of Clause 12, Article 2020 of the Labor Code actual salary payment period but not more than 3 months with 0% interest rate, maximum loan term of 12 months at Bank for Social Policies. The employer directly prepares a loan application, declares it, takes responsibility before the law for the accuracy and truthfulness of the number of employees who have stopped working, and data to determine the revenue that meets the loan conditions. c) At Point 1, Section III, amend and supplement as follows:

2. This Resolution takes effect from the date of signing for promulgation.

3.
